President of the Bar (Bâtonnier)
The President represents the Bar, oversees the discipline of all lawyers, settles disputes and ensures the proper functioning of the Bar Council.
Members are elected for three years by the General Assembly, by secret ballot, from among lawyers who have been on the Roll for at least five years. The Council allocates duties among its members.
It rules on admission to pupillage and enrolment on the Roll, and keeps the Roll and the pupillage list under the supervision of the National Council.
It ensures strict observance of the rules of the profession and upholds the principles of integrity, selflessness, moderation and collegiality.
Sitting as a disciplinary board, it sanctions misconduct by lawyers, upon complaint or on its own initiative.
It pays particular attention to the training of pupil lawyers and organises their lectures and obligations.
It runs a free legal consultation office for people in need and sets the conditions under which it operates.
It adopts the internal rules, manages the Bar's assets, prepares the budget, sets membership fees and checks lawyers' accounts.
Any breach of laws and regulations, any infringement of professional rules, any failure of integrity, honour or propriety exposes a lawyer to one of the following sanctions:
Any sanction also bars the lawyer from being elected President or Council member for up to five years.
A judge, a lawyer, a pupil or any interested person may file a complaint against a lawyer. Complaints are addressed to the President of the Bar, who refers them to the Council.
It brings together all lawyers on the Roll at least once a year, on the second Tuesday of October. It elects the President of the Bar, then the members of the Bar Council.
Elected for three years by secret ballot and absolute majority — with a run-off between the top two if needed — from among former Council members who have been on the Roll for more than five years.
Fifteen members elected for three years, not immediately re-eligible. It meets at least once a month and decides by majority, with more than half of its members present.
Elections and decisions of the General Assembly or the Bar Council may be referred to the National Council of the Bar within one month.
